Because the Company provides Services to medical care providers, PHI is instead governed by the applicable “Subscriber Agreements” as defined and further detailed in Section 3.5 of this Privacy Policy.

The type of information we collect about you depends on how you access and use our Website and the Services. In some cases, we collect information directly from you, while in other cases information is collected automatically through technologies such as cookies or obtained from third parties.

3.5 HIPAA Compliance and PHI
Our software may create, receive, maintain, or transmit PHI on behalf of healthcare providers who use our Services. When we process PHI on behalf of a healthcare provider, we act as a “Business Associate” as that term is defined under HIPAA. In such cases, our use and disclosure of PHI is governed by the Business Associate Agreement (“BAA”) entered into with the applicable healthcare provider and applicable provisions of HIPAA.
We use PHI solely to provide and support our medical scheduling Services, including appointment scheduling, patient communications, system administration, and technical support. We do not use or disclose PHI except as permitted by our agreements with healthcare providers, as required by law, or as otherwise permitted under HIPAA.
We implement administrative, physical, and technical safeguards designed to protect the confidentiality, integrity, and availability of electronic PHI. These safeguards include access controls, encryption where appropriate, system monitoring, workforce training, and risk management procedures. In the event we become aware of a breach involving PHI, we will notify the affected healthcare provider without unreasonable delay and in accordance with applicable HIPAA breach notification requirements.
3.5.1 Your Rights Pertaining to PHI
Patients whose information may be processed through the Services have certain rights regarding their medical information under HIPAA.
Healthcare providers that use our Services are responsible for maintaining and controlling patient medical records. As a result, requests relating to medical records should generally be directed to the healthcare provider with whom the patient has a relationship.

Request corrections or amendments to inaccurate or incomplete health information;.

We don’t use any of the information we collect from you for Automated Decision Making or Profiling.
5.2 Unsubscribe / Opt-Out

6.1 Information Retention.
We retain information as long as it is necessary and relevant for our operations. We also retain PI from closed accounts to comply with applicable law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Use, collect any fees owed, and take other actions permitted by law. After it is no longer necessary for us to retain information, we dispose of it according to our data retention and deletion policies.

9. OUR RESPONSE TO “DO NOT TRACK” SIGNALS

14. COMPLAINTS
